Bob Burns Golf Disclaimer and Return Policy

1.        Order Acceptance

a.       By placing an order with Bob Burns Golf (“Seller”), Buyer agrees to the Seller’s Terms and Conditions only.

b.      Any other terms and conditions will be considered void.

c.       The Terms and Conditions below will supersede any previous terms and conditions.

2.        Prices

a.       All orders are accepted on the basis of prices and terms prevailing at the time of shipment.  Prices and terms are subject to change without notice.  All prices are not negotiable.  Buyer must pay for shipping.

b.      Seller reserves the right to change specifications, modify product designs, or withdraw products or limit order quantities without prior notice.

c.       Seller is not responsible for any shipping changes incurred by the buyer for product: returns, repairs, trade-ins or exchanges.

3.        Terms

a.       Seller accepts several methods of payment:

             i.      Credit Card: Visa, Master, and all other major Credit Cards.

             ii.      Prepaid: Payment can be made by Personal Check or Money Order in US dollar funds.  For personal checks, please allow an additional 12 days to process checks.  Seller is not responsible for checks lost in the mail.  Sorry, Seller does not accept C.O.D. orders.

4.        Freight

a.       All shipments are shipped from our Appleton, Wisconsin facility.  Unless otherwise requested, all shipments are delivered via UPS or FedEx Ground Service.  Freight is charged at courier’s approximated costs, i.e. the final total of your order cannot be determined until contact information has been entered into web transactions.  Buyer is responsible for all freight charges; unclaimed or refused shipments are subject to a $15.00 handling charge plus freight and COD charges, due upon receipt of invoice. 

5.        Warranty

a.       All goods are covered by a limited lifetime warranty to be free of manufacturer’s defects in material and workmanship, under normal usage of play, only by the original order.  Verified by date of purchase with receipt, and only to cover defective merchandise, subject to Sellers inspection.  During this warranty period, Seller will repair or replace at his sole discretion.

b.      Damaged Product – upon arrival of damaged product, product specialists will examine the product to determine product failure.  If Bob Burns Golf deems that the breakage happened during normal usage of play, the product will be repaired or replaced and returned to the Buyer at no additional charge.  If at which point the product is believed to have been damaged through abuse or misuse not during regular play.  The buyer will be contacted, given his/her various options and pricing.

c.       Seller’s responsibility is limited within the first 30 days from original date of purchase only to the price paid for the product, not including shipping.  In no event shall be liable for any incident, consequential, or special damage of any kind or nature whatsoever including, but not limited to, lost profits or additional cost to disassemble clubs, alterations, and re-gripping.

d.      Claims due to improper repair or alteration procedures, product abuse are not covered by this warranty.  Any attempt to modify or alter Seller’s product (e.g. by bending hosel, re-shafting) shall void this warranty.

e.       Acts of God are not covered.

f.        Seller disclaims any warranty regarding merchantability, performance or fitness for purpose.

6.        Damaged Goods or Shortages

a.       For damages or shortages occurring during shipping, Buyer shall make claim against the carrier.  All claims for shortages or damages must be received by Seller within 48 hours upon receipt of shipment.  If you need help with this matter, please feel free to contact us by phone or email.  We are happy to help.

7.        Return Authorization

a.       No returns shall be accepted without a Return Authorization label pasted on the outside of the box and a valid cause with Seller’s prior written authorization. All return shipments must be accompanied by the original invoice. Due to the large volume of incoming and outgoing mail, the package or box must clearly have visible buyers name and address otherwise; all packages and boxed will be returned to sender at the buyers expense.

b.      All returns must be shipped Freight Prepaid. No C.O.D. shipment will be accepted.

c.       Buyer may return the merchandise to Seller within 30 days of original purchase date for refund of product minus shipping. All refunds are subject to return authorization and date of receipt. Please allow up to 30 days for refund to be issued from date of receipt.

8.        Back Orders

a.       Back order items will be shown on the invoice.  All back orders will be shipped out as soon as possible, unless canceled by Buyer prior to shipment.  Freight for back orders will be charged.

9.        Disclaimer

a.       All Bob Burns Golf equipment is designed by Bob Burns Golf, none of the products for sale is represented to be clones, copies, or imitations of any other club or model.  Seller disclaims Sec. 2:312 C of the Uniform Commercial Code.  

10.        Jurisdiction

a.       The laws of the State of Wisconsin shall govern the validity, interpretation, and performance of this agreement between Seller and Buyer.

11.        Trademarks

a.       No Bananas, Putt Mark, Roll-In putters by Bob Burns, Hyper Responsive Launch, No Chicken Wings are all registered trademarks of Bob burns Golf, Inc.  All other trademarks used in this site are property of the respective trademarks owners.

Bob Burns Golf is not responsible for any typographic or photographic errors.
